Those Terms and Conditions are intended to define the rules applicable in the context of the sale of products marketed on the e-commerce website www.mafabriquedeboutons.com (hereinafter "the Website"), between

Any legal person or adult natural person, having the legal capacity to contract, domiciled exclusively in the countries delivered by mafabriquedeboutons.com (hereinafter "the Customer") purchasing a Product on the Site.

For the application of these conditions, it is agreed that the Customer and CREPIN PETIT S N will be collectively referred to as the “Parties” and individually referred to as the “Party”.

These terms and conditions (hereinafter the “General Conditions of Sale”) govern without restriction the sales of Products made by CREPIN PETIT S N from the Site.

The site is published by CREPIN PETIT S N and hosted in Paris at PlanetHoster, a service provider whose head office is located at 4416 Louis B. Mayer, Laval (Quebec) H7P0G1, Canada.

Any order of article (s) carried out on the site supposes the consultation and the express acceptance of the present general conditions of sale, without however this acceptance being conditioned by a handwritten signature on behalf of the internet customer.

CREPIN PETIT S N reserves the right to modify these terms and conditions at any time by publishing a new version on the Site. The applicable terms and conditions are those in force on the Site on the date the Customer places the order; it being specified that any order for a Product offered on the Site implies full acceptance by the Customer of the General Conditions of Sale in force at the time of placing his order.

ARTICLE 1  DEFINITION

The purpose of these Terms and Conditions is to define the conditions under which the Products are marketed by CREPIN PETIT S N to the Customer. They thus regulate the various stages of carrying out the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.

ARTICLE 2  PRODUCTS

The Products offered for sale by CREPIN PETIT S N are those appearing on the Site on the day of consultation by the Customer. Each Product will be the subject of a description sheet which, in addition to the photograph (s), will contain: the price, the sizes and colors available, the particular characteristics as well as any customization. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and the definition of the colors of the user's screen.

These photographs, although being as faithful as possible, cannot therefore ensure a perfect similarity with the products offered (in particular with regard to the colors) and do not enter into the contractual field.

 

The Customer benefits from the legal guarantees provided for by Articles L211-1 et seq. Of the Consumer Code (legal guarantee of conformity) and the Civil Code (legal guarantee against hidden defects).

CREPIN PETIT S N undertakes to deliver Products that meet the requirements in force relating to the safety and health of persons in accordance with European provisions, and in particular the legislation on regulated chemicals.

ARTICLE 3  PRICES

The prices are indicated in euros all taxes included, excluding delivery costs; it being specified that the value added tax is that in force in mainland France on the day of the order placement.

The prices applied are those communicated on the Site and confirmed to the Customer during the order placement.

The delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed inclusive of all taxes. These costs are the responsibility of the Customer and are invoiced in addition to the sale price of the Products.

The transfer of the risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Customer.

CREPIN PETIT S N reserves the right to modify its prices at any time but undertakes to apply the prices indicated on the Site at the time of the Customer's order.

CREPIN PETIT SN informs the Customer that in the event of an incorrect, obviously derisory price (low price) being displayed, whatever the reason (computer bug, manual error, technical error.), The order - even validated by itself - will be canceled, the Customer will then be informed as soon as possible. He will then be able, if he wishes, to reorder his order at the corrected and exact price.



ARTICLE 4  ORDERS

4.1 ORDER PLACEMENT

The Customer materializes his order by completing the following 6 steps

Step 1: the Customer selects the chosen Products and adds them to his basket after having, if necessary, selected the desired size and color.

The basket (icon located at the top right of the screen) informs the Customer that he has taken the selections into account by indicating the number of Products it contains.

Step 2: The Customer checks the contents of his basket by clicking on "order" in order to have access to the summary of his order. The Customer can then modify his order (Product, size, quantity).

The total amount including tax of the order, as well as the delivery costs, are then indicated in the summary.

 

Step 3: once the order has been verified and if necessary modified, the Customer validates his basket in order to finalize his order by clicking again on "order".

If the Customer has an discount code, he must enter it in the space provided for this purpose in order to benefit from it.

Step 4: Customer input of delivery and billing details

Apart from the date of birth and the additional address, all fields are necessary to complete the order. Unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address.

If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will identify himself only with his email address and password.

At this stage, the customer will have the possibility to leave a message about his order.

Step 5: choice of delivery method

The customer chooses the delivery method (carrier or factory pick-up). The amount of delivery costs is, where applicable, added to the amount of the items ordered. He also certifies that he is aware of these general conditions of sale by checking the corresponding box, which allows access to the next step.

Step 6: choice of payment method and possible entry of bank details

The customer chooses the method of payment: credit card or PayPal.

If he wishes to pay by credit card, he is then redirected to the secure payment screen of the partner of CREPIN PETIT S N as specified in article 4.3 below.

The Customer must enter his bank card number, its validity date as well as the 3 numbers of the visual cryptogram on the back of his card, it being specified that in the event of payment by American Express card, the Customer must communicate 4 digits.

If the payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.


4.2 ORDER CONFIRMATION

Upon acceptance of payment from the Customer, the Customer will receive an email confirming his order, summarizing all the items ordered as well as the billing and delivery address.

The validation of the order by the Customer and the order confirmation sent to the Customer by email by CREPIN PETIT S N following the acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Conditions of Sale.

 

The Customer who has placed an order will be able to print his invoice as soon as the order is shipped by logging onto the Site in the order tracking area provided for this purpose.

CREPIN PETIT S N reserves the right not to validate the order in the event of:

abnormal or abusive complaints,

abnormal orders with regard to the quantities ordered,

abnormal or abusive exchanges and returns,

existing dispute(s) with the customer.

The Site's customer service is available to the Customer for any questions relating to his order. Customer service is available by email (contact@mafabriquedeboutons.com) or through the contact form on the website, from Monday to Friday, 9 a.m. to 12 p.m. and 1:30 p.m. to 5 p.m (UTC+2).


4.3 PAYEMENT

The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer. Payment is made online by credit card or Paypal at the time of validation of the order placement.

The customer is redirected via a secure connection to our Payzen partners LYRA NETWORK for Credit du Nord or Paypal who then manage the rest of the transaction.

In the event of a payment default, an incorrect address or any other problem on the Customer's account, CREPIN PETIT S N reserves the right to block the Customer's order until the problem is resolved.

Transactions carried out for the benefit of the Site are secured by the payment systems of CREPIN PETIT S N partners:

All information exchanged to process payment is encrypted using SSL (Secure Socket Layer). This data cannot be detected, intercepted or used by third parties. At no time does the Client's financial data pass through the CREPIN PETIT S N computer system. Our partners check that the connection with the Client's browser is secure before sending the payment form to the banking institution carrying out the transaction. financial.

Paypal being a technical service provider, it does not take charge of disputes related to orders which are processed directly by CREPIN PETIT S N as specified above or, where applicable, by the Customer's bank.


4.4 ORDER ARCHIVING

The order confirmation is recorded in the registers of CREPIN PETIT S N, themselves kept on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.

ARTICLE 5 • DELIVERY

CREPIN PETIT will ship orders accompanied by a delivery slip within a maximum of ten (10) working days for delivery to mainland France, and twenty (20) working days for delivery to any other destination, and this from the day following the payment of the order.

Any order registered on the Site from Monday to Friday before 11 am will be processed the same day; after 11 a.m. it will be processed the next day. Any order placed on Friday after 11 am, Saturday and Sunday will be processed the following Monday; it being specified that orders placed on a public holiday will be processed the following working day.

If the delivery time is exceeded and not justified, the Customer may request the resolution of the sale and obtain, within a maximum period of 14 (fourteen) days, the refund of the sums paid on the concerned order.



ARTICLE 6 • RECEIPT OF THE ORDER – CLAIMS - RETURNS 

The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery. Any anomaly concerning the delivery such as:

damaged package,

missing products,

deteriorated products,

products not in accordance with the order,

must be notified within 14 (fourteen) days of receipt of the order.

This notification will be sent to the Site's customer service either:

After this period, and unless there is a hidden defect, no complaint will be accepted by CREPIN PETIT S N, the Products then being deemed to be compliant.

 

For any return of a non-compliant product, the Customer must return them, either in their original packaging, or in packaging protecting the product against any deterioration, with their label and any accessories allowing their re-marketing, to the address next :

This return will be accompanied by the return slip that the customer will have received by email from customer service following his notification of non-compliance.

The risks and costs of return are the sole responsibility of the Customer.

When the non-conformity has been observed, CREPIN PETIT S N will offer the Customer either:

the replacement of the Product (s) at the expense of CREPIN PETIT S N, or

the refund of the price of the order (price of the Products and delivery costs) within fourteen (14) days from the date of dispatch of the notification of confirmation of the non-compliance by the Site's customer service.

In the event of a refund, CREPIN PETIT S N will refund all the products made compliant, as well as the shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery.

ARTICLE 7 • RIGHT OF WITHDRAWAL 

The Customer has a period of fourteen (14) working days from the date of receipt of his order, to return the Products ordered, without justification or penalty except in the case of personalization: personalized products at the Customer's request does not fall within the scope of the right of withdrawal.

For any return, the procedure below must be fully respected:

The customer will fill in the withdrawal form available in his customer area. He will then receive a return slip that he must imperatively enclose with the returned products.

the risks and costs of return are the sole responsibility of the Customer.

Subject to the above conditions, CREPIN PETIT S N will reimburse the customer the amount including tax of the order (product price and delivery costs) excluding return costs. The Customer's bank account will be credited with the said amount, within fourteen (14) days of receipt of the Products by CREPIN PETIT S N.

ARTICLE 8 • PERSONAL DATA

CREPIN PETIT S N collects a certain amount of information necessary to process orders.

These data are not only necessary for the processing of the Customer's order by CREPIN PETIT S N, but also to communicate information to the Customer on the Site or to allow him to benefit from commercial offers: the Customer accepts it by validating his order.

The information is strictly confidential and is mentioned with an asterisk (*) when it is necessary for CREPIN PETIT S N, and / or its service providers as part of the management of the Customer's order.

Following any injunction from the legal authorities or in order to defend its rights or those of its employees, customers or any other person, CREPIN PETIT S N may communicate this data to legally authorized bodies and authorities.

CREPIN PETIT S N undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer's personal information from being distorted, corrupted or that unauthorized third parties have access to it.

The Customer's personal information is sent and stored with the site host located in France, the contact details of which appear on the site under the "Legal Notice" section and at the beginning of this document.

In accordance with the "Informatique et Liberté" law of January 6, 1978, as amended by the law of August 6, 2004, the Customer has the right to access, rectify, modify and delete data concerning him.

The site is declared to the National Commission for Computing and Liberties - CNIL under number 2012601. The Customer can exercise this right by sending a letter to the following address or by email, specifying his name, first name, email and postal address:

The Customer can also modify his personal details from his customer area by identifying himself using his email address and password.

ARTICLE 9 • COOKIES

In order to process the Customer's order, and in order to better understand their needs and to personalize the services offered on the Site, CREPIN PETIT S N uses cookies. The cookie is a computer file, stored on the hard drive of the Client's microcomputer, the purpose of which is to indicate its visit to the Site.

The cookies memorize the length of the Customer's visit to the Site, his identity (known through his e-mail address and password) and the contents of his basket. Once disconnected from the Site, this information is kept for 20 (twenty) days before being permanently deleted.

The Customer can oppose the registration of cookies by configuring his Internet browser. He then loses all personalization of the service offered to him on the Site.

ARTICLE 10 • LIMITS OF LIABILITY

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, in particular with regard to technical performance, response times, connection times, queries or information transfers, the risks of cut, the risks of contamination by viruses circulating on the network and in general all the risks associated with the use of the Internet network.

CREPIN PETIT SN can therefore in no way be held responsible for any direct or indirect damage resulting from improper use or incident related to the use of the computer, Internet access, maintenance or malfunction of the servers, the telephone line or any other technical connection, the connection of the Customer to the Site being made under his full responsibility.

ARTICLE 11 • FORCE MAJEURE

CREPIN PETIT SN will not be responsible for the total or partial non-fulfillment of its obligations under the order placed by the Customer, if this non-fulfillment is caused by an event constituting a case of force majeure as defined by positive law.

In such a case, CREPIN PETIT S N will inform the Customer of the occurrence of such an event within 3 (three) clear days of its occurrence, by email.

After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be canceled and will, if applicable, be reimbursed by of CREPIN PETIT SN on the bank card used to place the order within a maximum period of 30 (thirty) days.

Article 12 : MAINTENANCE AND SERVICE INTERRUPTION 

CREPIN PETIT reserves the right, at any time, to temporarily interrupt access to all or part of the site for technical reasons, to modify the contractual conditions or to bring the site into compliance with legal or regulatory provisions and this, without having to inform the customer beforehand.

ARTICLE 13 • INTELLECTUAL PROPERTY

In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, all elements, brands, designs, models, logos, graphics ... on the Site as well as their compilation are the exclusive property of CREPIN PETIT SN, the latter does not grant any license, nor any right other than that of consulting the site.

The reproduction or use of all or part of these elements is only authorized for the exclusive purposes of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use constitutes an infringement and punishable under Intellectual Property, except with the prior written authorization of CREPIN PETIT S N.

ARTICLE 14 • APPLICABLE LAW

If any of the terms of these Terms and Conditions were declared null, illegal or unenforceable by a court decision, the others will remain in force.

The Terms and conditions are executed and interpreted in accordance with French law. The applicable language is the French language.

In the event of a dispute, the client should apply as a priority to CREPIN PETIT S N to obtain an amicable solution and in the absence of an agreement, the ordinary courts will have sole jurisdiction.
